In this paper we will be discussing the ethical risks of the transcendental quality of virtual spaces as they apply to digital health, especially in relation to new attempts to construct a “social mediome.” As we will discuss in the following section, phenomenology has raised criticisms against the context-lessness and ethical opacity of technology. The creation of a social mediome seems to come as an answer to this criticism as it creates a context that gives voice and flesh to human (...) beings within their virtual lives. Yet, as we will discuss in this paper, the transcendental quality of this social mediome might involve the risk of normalizing health in a way that would prevent individuals from achieving well-being according to the meaning that they personally attribute to it. This paper critiques the biological race realism of Quayshawn Spencer. Spencer's recent embrace of “radical race pluralism” (RRP) is welcome but incomplete, because it needs methods that distinguish different communicative contexts for how American English speakers use “race” and related terms. I offer a pragmatic approach to identifying such contexts that combines pragmatic argumentation theory, rhetorical polysemy, and a pragmatic approach to definition. One consequence of embracing RRP is that Spencer's theory of “OMB race talk” is unsupportable because it collapses (...) three distinct communicative contexts: genomic research, legal and regulatory governance, and ordinary talk. By so doing, OMB race talk blocks attempts to fight racism and violates ethical standards that should allow people the agency to define their own identities. (shrink)

Philosophical defenses of cognitive/evolutionary psychological accounts of racialism claim that classification based on phenotypical features of humans was common historically and is evidence for a species-typical, cognitive mechanism for essentializing. They conclude that social constructionist accounts of racialism must be supplemented by cognitive/evolutionary psychology. This article argues that phenotypical classifications were uncommon historically until such classifications were socially constructed. Moreover, some philosophers equivocate between two different meanings of “racial thinking.” The article concludes that social constructionist accounts are far more robust (...) than psychological accounts for the origins of racialism. The disagreement between John Duns Scotus and William of Ockham on whether the exterior act has intrinsic moral worth is a turning point for a new understanding of the relationship between the interior and the exterior act. Is someone who successfully commits murder as guilty as someone who fails in her attempt? Does the martyr merit more than someone who merely wills to undergo martyrdom but is denied the opportunity? In these cases, the completion of the act is the exterior (...) act, and the interior act is that part of the act which leads up to and includes the agent’s choice or command. Scotus synthesizes and develops an earlier tradition in which the exterior act has its own moral goodness or malice which is independent from that of the interior act. Ockham criticizes Scotus and this tradition, thus apparently becoming one of the first thinkers since Abelard to deny that the exterior act has any intrinsic moral value. Ockham redefines the exterior act as a purely natural act without intrinsic moral value and consequently traces the goodness or malice of an act entirely to an intrinsically moral act of the will. _The Structures of the Life-World _is the final focus of twenty-seven years of Alfred Schutz's labor, encompassing the fruits of his work between 1932 and his death in 1959. This book represents Schutz's seminal attempt to achieve a comprehensive grasp of the nature of social reality. Here he integrates his theory of relevance with his analysis of social structures. Thomas Luckmann, a former student of Schutz's, completed the manuscript for publication after Schutz's untimely death.

The spectacular development of medical knowledge over the last two centuries has brought intrusive advances in the capabilities of medical technology. These advances have been remarkable over the last century, but especially over the last few decades, culminating in such high technology interventions as heart transplants and renal dialysis. These increases in medical powers have attracted societal interest in acquiring more such knowledge. They have also spawned concerns regarding the use of human subjects in research and regarding the byproducts of (...) basic research as in the recent recombinant DNA debate. As a consequence of the development of new biomedical knowledge, physicians and biomedical scientists have been placed in positions of new power and responsibility. The emergence of this group of powerful and knowledgeable experts has occasioned debates regarding the accountability of physicians and biomedical scientists. But beyond that, the very investment of resources in the acquisition of new knowledge has been questioned. Societies must decide whether finite resources would not be better invested at this juncture, or in general, in the alleviation of the problems of hunger or in raising general health standards through interventions which are less dependent on the intensive use of high technology. To put issues in this fashion touches on philosophical notions concerning the claims of distributive justice and the ownership of biomedical knowledge. (shrink)

The disagreement over whether Aristotle recognized rights in some form unavoidably involves disagreement over what rights are, and the theory of rights itself is still highly contested. There is no consensus concerning how " right'? is to be defined, how rights are to be theoretically grounded, or how rights theory is to be applied in particular circumstances. This is not, however, a good reason to dismiss the issue of whether there are rights in Aristotle: for Aristotle, like modern rights theorists, (...) is concerned about the moral and legal status of the individual within the community, and he expresses this in terms of claims of justice. The issue is worthy of study not only because it can lead to a deeper understanding of Aristotle's conceptions of justice and the common good, but also because it may shed valuable light on the theoretical foundations of human rights, since he offers a theory of political justice which is based on a metaphysical theory of human nature. As the editors fully perceived, the new critical edition of the so-called commentary of Bernardus Silvestris on the Aeneid of Vergil was but a stage in the development of a basic knowledge of this important work. We could not, with the data available to us, solve certain major problems relating to author and text. We could not, for example, confidently name the author, nor could we adequately describe the genesis of the work. Recently, two studies have appeared — the first (...) by E. R. Smits, the second by Christopher Baswell — which seek to address these questions. The present article will in the main be a critique of these studies. In my view the two scholars perform a valuable service in bringing forward new material to which others may react, but the principal suggestion of Smits must be rejected and the conclusions of Baswell require modification. One problem that has been plaguing for the long term is the problem of choosing the levels of rational corpora. Since what goes into a corpus is what has a probability higher than the index of that corpus, that index has a bearing on what is in a corpus. We have two levels to deal with, since the focus is both with the evidential corpus and with the practical corpus. What principles can be used to select these levels? A practical (...) way to approach this question is through the analysis of full belief or acceptance. Partial belief is distinguished in terms of a propensity to make, or fail to make, bets. I argue in this paper that philosophers have tended to neglect most autobiographies, even explicitly philosophical ones, due to invalid presuppositions about genre demarcations, and that they would do well to consider them for the resources they offer in terms of constituting positions on selfhood and agency. I further argue that Jacques Derrida offers a productive theoretical framework for understanding philosophical autobiographies as performances, or instances of "making" the truth (Augustine's veritatem facere) by "testifying" or "witnessing," and analyze both Derrida's (...) "Circumfession" and Søren Kierkegaard's 'On My Work as an Author' as examples of this kind of performance. (shrink)

In both law and ethics, precedent shapes the deliberation of novel issues. Despite the interconnection between new and old decisions, few research ethics boards have an explicit mechanism for archiving issue-based research ethics decisions to inform future decisions. With the intent of promoting expediency, consistency, and accountability in REB decision-making, Sunnybrook Health Sciences Centre implemented a “decision bank”: a formal mechanism for systematically capturing institutional REB decisions. We describe the development of the decision bank, its implementation, and the lessons we (...) have learned from both. The decision bank, which is categorized by general issue themes such as consent, study design, and privacy, is still in the early implementation phase, but it provides a much-needed method to address the paucity of formal mechanisms and literature in a biomedical field otherwise inundated with evidence-based information. Is Kantian Ethics guilty of utopian thinking? First, potentially good and bad uses of utopian ideals are distinguished, then an apparent path is traced from Rousseau’s unworkable political ideal to Kant’s ethical ideal. Three versions of Kant’s Categorical Imperative are examined briefly for the ways that they may raise the suspicion that they manifest or encourage bad utopian thinking. In each case Kantians have available responses to counter the suspicion, but special attention is directed to the version that says “Act (...) on the maxims of a universally law–giving member of a kingdom of ends.” Interpretations vary, but here primary focus is on one contemporary reconstruction and development of this central idea. Several objections suggest that this idea encourages bad utopian thinking are briefly addressed: that we cannot count on everyone to follow ideal rules, that even conscientious people disagree in their moral judgments, and that theories that allow exceptions to familiar moral rules create a “slippery slope” to moral chaos. In this excellent book, George A. Panichas, longtime editor of the conservative quarterly Modern Age, brings to a conclusion a critical trilogy, really a tetralogy, which includes The Reverent Discipline, The Courage of Judgment, and The Critic as Conservator. The unusual title is inspired by Plato’s Phaedrus, with Panichas writing at one point—concerning literary scholar Austin Warren’s “open celebration of great ideas, great writers, great souls”—that, “Literary greatness for him meant spiritual greatness, this is, the kind of greatness that gives (...) us guidance and helps to orient us towards the good, or, as Plato puts it, to make us ‘grow wings to overcome gravity’”.
